Terms of Service
1. Agreement to these Terms
These Terms of Service (“Terms”) govern your use of the ezTalk application, related services, and website (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What ezTalk provides
ezTalk is a personalized assistive communication app. Depending on availability and your choices, it may provide personalized speech recognition, context-aware AI correction, intent completion, translation, and optional text-to-speech.
The Service is designed to assist expression, not replace user intent. Features, availability, supported languages, and performance may change over time.
3. Eligibility and supervision
You must be legally able to agree to these Terms. If you use the Service on behalf of another person or organization, you represent that you have authority to do so. A minor may use the Service only with the involvement and permission of a parent, guardian, school, or other authorized adult as required by applicable law.
4. Accounts and Google sign-in
Some features may require Google sign-in. You are responsible for safeguarding your device and account credentials and for activity under your account. You agree to provide accurate information and promptly notify us if you suspect unauthorized use. Your use of Google services is also governed by Google’s applicable terms and policies.
5. Acceptable use
You may use the Service only lawfully and in accordance with these Terms. You must not:
- use the Service to violate law or another person’s rights;
- upload or transmit content you do not have the right to use;
- interfere with, probe, overload, or circumvent the Service or its security;
- introduce malware or use automated means to abuse the Service;
- misrepresent AI-generated or assisted output in a deceptive or harmful way; or
- attempt to reverse engineer the Service except where applicable law expressly permits it.
6. Your content and responsibility
You retain any rights you hold in speech, text, prompts, personalization information, corrections, and other content you provide (“Your Content”). You grant us a limited, non-exclusive license to process Your Content only as needed to operate, secure, support, and improve the Service in accordance with our Privacy Policy and your settings.
You are responsible for Your Content and for ensuring you have any permissions needed to provide it. You remain responsible for reviewing, choosing, and communicating any final message.
7. AI-assisted output
AI-assisted results—including corrections, completions, translations, and synthesized speech—may be inaccurate, incomplete, or inappropriate for a particular context. Output may not be unique. You should review output before relying on or sharing it, especially in sensitive, urgent, legal, financial, safety-critical, or health-related situations.
ezTalk is not a medical device, emergency service, or substitute for professional advice. Do not rely on it as the sole method of communication in an emergency or where an error could cause harm.
8. Third-party services
The Service may interact with third-party services, including Google authentication and AI services. We do not control those services, and their terms and privacy policies apply. We are not responsible for third-party services to the extent permitted by law.
9. Service ownership
Except for Your Content and third-party materials, ezTalk and its associated software, design, and content are owned by the developer or applicable licensors and are protected by intellectual property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for its intended purpose; they do not transfer ownership.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that speech recognition, correction, translation, completion, or text-to-speech will always be accurate or available.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, ezTalk’s developer and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or opportunity arising from your use of or inability to use the Service.
Where liability cannot be excluded, it will be limited to the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or US$100. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
12. Suspension and ending use
You may stop using the Service at any time and may revoke Google access through your Google Account. We may suspend or terminate access when reasonably necessary to protect users or the Service, address violations, comply with law, or discontinue the Service. Provisions that by their nature should survive will remain in effect.
13. Changes
We may update the Service or these Terms. We will post revised Terms and update the effective date. If a change is material, we will provide additional notice where reasonably appropriate or legally required. Continued use after updated Terms take effect means you accept them.
14. Applicable law
These Terms are governed by the laws that apply in the jurisdiction where the ezTalk developer is established, without regard to conflict-of-law rules, except where mandatory consumer law provides otherwise. Nothing in these Terms limits rights you cannot waive under applicable law.
15. General
If any provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or transfer of the Service, subject to applicable law. These Terms and the Privacy Policy are the entire agreement concerning the Service.
